This Handbook has been written with an aim to serve as a ready reference for the officers of the Indian Army who would like to know something about their legal rights and responsibilities. It covers important definitions, rights and privileges, conditions of service, jurisdiction, military crimes, court of inquiry, administrative action, grievance redress, summary punishments, court martial process, and jurisdiction and power of the Armed Forces Tribunal. It includes provisions contained in the Indian Penal Code, the Code of Criminal Procedure and the Indian Evidence Act, as they relate to the personnel of the Indian Army.

 

Other contemporary issues included in the book are the aid to civil power, the Armed Forces (Special Powers) Act, the role of the National Human Rights Commission, Rights to Information Act, Geneva Conventions and the international humanitarian law as applicable in the UN peacekeeping missions. 

The Handbook covers the syllabus of Part B and D of the promotion examination and Staff Course entrance examinations. 

About The Author

 


Wing Commander (Retd) Dr U C Jha was awarded Ph D in Law and Governance by Jawaharlal Nehru University. He also holds masters degree in law, life sciences, business administration and defence and strategic studies; with post-graduate diplomas in intellectual property right laws, environmental laws, training and development, and international humanitarian law, refugee law and human rights laws.

 

Wg Cdr Jha has 24 years of commissioned service to his credit. He has been visiting faculty at few law institutions and the United Services Institution of India, Delhi. His work comprises five books: The Military Justice System in India: An Analysis, The Armed Forces Tribunal, Indian Armed Forces: Socio-Legal Perspective, The South Asia Military Law Systems, and Human Rights and Justice: International Documents; and over 60 articles and research papers.
